We have an employee who is telling me that she cannot do a portion of her job due to asthma. She is a machine operator and part of her job is to go into the Finishing department when needed and assist on the plating and powder coating lines. This was something that was discussed with her during her interview and something she did during her probationary period.
I have provided paperwork to her on three separate occasions informing her that any medical restrictions require medical certification but she has not brought anything back.
In addition, we are covered under a CBA which states that if an employee is unable to carry out their tasks due to medical issues, we are to look for work outside of their job but at no time can we "bump" another employee from their job to accomodate the restricted employee.
This employee has not yet been here a year so no FMLA.
In addition, she complains of "wheezing" but is constantly smoking!!!
What would you recommend??
