I recommend we appoint a liberal from California who favors abortion, abolition of all religious freedom and the outlawing of any employer initiative to make work rules regarding his employees.

I predict there will be serious discussions on the meaning of "Advise and Consent" relative to congresses role in approving new Supremes. Bush may say, "Thank you for your input, I'm naming XYZ to the post anyway".

Well, Bush never has been a team player. His autocratic tendencies are what led some commentator (can't remember who) to refer to him as King George II.

Controversy over the Supremes goes back to the founding fathers. And down thru the years there have been many controversies concerning the Advise and Consent policy. Following a strict interpretation of the Constitution, Bush has the right to thank Congress for their opinion then do what he believes is best. Perfectly legal, just as his appointment of Bolton was. Other presidents have done just that with lower level judges, so there is no reason it couldn't be done with a Supreme - same process and same rules.
