Copies of Medical Records

It is my understanding that employees are entitled to copies of ALL their company medical records. Is this true?

  • OSHA requires that any and all medical or training records related to bloodborne pathogens be available upon request to the employee, with copies, or to those representing the employee at the employee's request.

    Medical records related to workers compensation may or not be available to employees as determined by your individual state's law.

    The FMLA does not address having medical records because it is not comtemplated that you would have any in order to approve a medical certification.

    Any other records, including separate medical files, are legally part of the personnel file, even though physically separate, and would not necessarily be available to employees unless mandated by state law. Federal law does not mandate an employee's access to such records. Your regular policy would apply.
