Separation Agreement

When an employee terminates, do you require them to sign a voluntary or involuntary separation agreement? If so, what language and information does it include?

  • I see no one has jumped in with an answer. Each separation agreement we use is specifically created to be applicable to the employee and the reason for separation. We use an attorney to help us with the verbiage. I suggest that your company do the same.
  • Different separation agreements drafted by your lawyer sounds good to me, but your question asked if they are required to sign one in a termination. I don't think you can require a terminating EE to sign anything, of course neither party gets the consideration being offered as part of the agreement. That obviously has ramifications for both the Company and the terminating EE. So no requirements for not signing, but definitely consequences.
