Lunch breaks for hourly employees

Is there a state law in NC that requires employers to give hourly employees paid lunch breaks?

Does any one know where I can get a copy of this document?

  • Sir or Madam, I am editor of the NC Employment Law Letter. There is no NC law requiring that employees get paid during a lunch break. Under federal law the employee does not have to be paid unless the employee is performing work. The NC Dept. of Labor has a website which responds to this question or you can further verify with your own atty. I'd be happy to talk to you further about this issue.


  • Remember that breaks under a certain amount of time (I believe its 20 minutes, but I would have to check the federal regs to be positive), must be paid.

    So if you are giving only a few minutes for lunch, it may have to be paid!
