Employee's access to personnel file

Forgive me if this has already been posted. I looked and could not find it specifically:

If an employee requests to see his personnel file, we have a policy that requires a representative of HR to be present during this review. But, what if he asks to make copies of any or all of the information in the file? Does he have that right? Or, is it considered property of the employer? If this is a state-by-state regulation, I'm writing from Indiana.

  • You might want to check with your state DOL to see if there is a statute on personnel file access. In MN, former employees are entitled to one copy of everything contained in their personnel files, at company expense, within one year of termination. Current employees are entitled to view their personnel once every six months upon written request. xB-)
