I-9's

Those employees who have been working for our company for more than three years, may we destroyed their I-9 form? Also, what about independent contractors, must we make sure that their social security are valid?

  • We recommend that you keep an I-9 for the full period of of the worker's employment plus one year or for at least three years, whichever is longer. In California, you are not required to verify the independent contractor's social security number, but you must obtain it (or an identification number) in order to file the Independent Contractor Reporting Form with the state EDD. As of January 1, 2001, California employers are required to file this form within 20 days of either making payments totaling $600 or more or entering into a contract for $600 or more with an independent contractor in any calendar year.
