An employer is shutting down or transferring a facility. It appears the shut down or transfer may be delayed. The employer intended to pay accumulated paid time off when the transfer occurred.
Can the employer now force the employees to take paid time off during this delay period, thus reducing its future liability when the transfer really does occur?
