Court Subpoena

The State Attorney's office has subpoenaed two former employees (one case involves a Firefigher the other case involves a Police Officer)of the City. The case involves events that the former employees were involved in as part of their duties with the City. I am trying to find out from Wage and Hour if their time in court is considered wages and payable by the City. I was curious about how other employers handle these situations? Do you add these employees back to the payroll? Or is the court obligated to pay them?
