Garnishment

I have a quick question. We were served with papers for garnishment of one of our ees. How much do we take out? Isn't it a standard percentage? Where do I find out about this?

The garnishments we receive in California always tell us how much to deduct. It's always a percentage of disposable wages, which is gross wages minus taxes.

State garnishment procedures should be on-line. If they're not or in any event, call the "If you have questions" phone number that is usually listed on the front or back of the garnishment order.

When I received my first garnishment order, I called the number listed and the clerk (very helpfully) faxed me the pertinent part of the garnishment rules, which told me exactly what to do.

The garnishments that I've seen have several pages of fine print. It's a lot of lingo to decipher but I believe the garnishment must leave them at least with minimum wage. Keep in mind that the minimum wage for states may be different than the federal minimum wage.

Just an aside, make sure the garnishment has been properly issued and served. For example, here in Delaware, if we receive a garnishment from say, California, we can reject it and state that the garnishment order must come through the proper channels of the Delaware court system. This is a basic summary so I suggest a brief phone call to your counselor.
