Not in my opinion. Overtime is for hours WORKED over 40 hours. Travel stipends (reimbursement, expenses) are paid because the work takes the ee i=out into the field. Because of laws, some are counted toward wages and are taxable, but I don't see how that would effect overtime calculations.
I agree. Stipends are like per diem, not actually reimbursement for expenses claimed, and they may have to be shown as wages on the W-2, but they are not considered hours worked under the FLSA.
Same here. The college where my wife works is always adding some little stipend on her check for this or that and it is included in her total wages. Have you considered having your ee's complete an expence voucher, with receipts attached, to be paid back for the money they have spent on food/travel?
