Can't Get Paid

Nephew hired by a Towing Company. Has worked 125.5 hours in 11 days. Now Towing Company says they don't have to pay him because he was in "training."

What are his recourses?

If he was hired he needs to be paid for hours worked training or not.

FLSA people would love to get their hands on this information. I would suspect he is not the first EE they have had their way with. Have him start looking for other work while your state DOL looks into the allegations.

Is it possible they pay a lower "training level" wage for the first 30 days or so and your nephew misunderstood? And don't forget the overtime part of the calculation.

No, the owner told him they "don't pay while you are being trained."

My sister is going to call the Wage and Hour people in Louisville, KY today.

Evidently other employees have had trouble getting paid also. I don't understand why, because the towing company is all over this town towing vehicles. They are a well known company.

I went through this myself years ago. Got hold of the Federal Dept. of Labor, explained that I was owed $1200. Feds called former employer, who sent a check to me pronto !
