Clerical Error

Upon reviewing hours worked on an hourly paid employee, I noticed the employee had not been punching in or out for lunch. This was not caught by the manager of the office nor the payroll department. Also, on at least three other ocassions the employees clock-in and clock-out times were wrong resulting in her receiving more pay than she was entitled to. How far back can an employer go to recoup the overpayment of compensation to an employee in this situation?

We are a private employer with about 50 employees. The incidents date back to October 2003 when the employee began her course of employment with us.

  • You are free to correct the error. Do an accounting showing the amount of overpayment, and meet with the ee to put a pay back in place. If no agreement, and you are absolutely certain of your position, you can deduct the overpayment w/o ee written approval. Still, I would attempt to get the approval. This was money the ee never was entitled to, and you have some lattitude in getting it back.
