Scheduling

Is there any law, federal or state (I'm in WI) that mandates that a full 8 hours must be missed between shifts? We are a manufactuing facility whose policy currently states that a full 8 hours must be missed between shifts which would not allow an employee to work both first and second shift on one day. I have been asked if this is a law and cannot find anything.

  • I don't believe there is such a requirement. What's the difference between working two consecutive shifts, or working 8 hours of overtime at the end of the first shift? Or, working a 10 or 12 hour shift in the first place. I think your contract will be controlling.
  • I don't know about Wi, but no such federal requirement. Maybe all it means is that the ee is entitled to 8 hours off between the time he leaves and the time he returns, which means he could work 2 or even 3 shifts so long as he had an 8 hour break. Strange policy if it means what you seem to say it does.
