Work in two different States

We have an employee who lives and works for us in Oregon(OT only over 40 hrs week). However, there are times he may work on a small project in California - when he does, are we required to pay him as a Calif. employee (OT over 8 in a day as well)?

I think that it goes by his residence and where he pays taxes and you pay payroll taxes. He just happens to work in California occasionally - that doesn't make him a California employee.

I agree with Gillian - the regulations require you pay them according to which state they reside in and where you pay taxes into.

Be careful with the reside issue. I have employees that live in New Jersey but work in New York. The State of New York requires anyone who "works" in their state to pay taxes in that state. I have found this also with Maryland and Washington. So check with the Department of Revenue in the State where they are working.
