Quick Help Needed - Misappropriation and Reimbursement

I have an employee who misappropriated $119 through company "cash" coupons and money off coupons she fraudulently received by upgrading her player status in the club computer - she's a club associate. She is being discharged. Can I legally take the $119 out of her final paycheck? I didn't think so, but can't hurt to check.

No, but you can attempt to recover in court after the fact.

Devil's advocate: So, what happens if you just go ahead with the deduction, advise her with a note what you did and see what happens. Otherwise, it'll cost you way much more than that to recover it through the legal system. I would think Casinos would have had an industry-wide ready-answer for this one dealing with what they deal with. So, maybe an attorney out there will tell us what you risk by simply deducting it from her final check.

Generally (in most states)you can't "garnish" wages from an employee, but I would certainly ask her to reimburse it. If she wants you to take it out of her final check, I would get her ok in writing.
