Exempt to Hourly Laws

I have a team leader/supervisor that has taken a position as Admin. Asst., should this person be changed to an hourly employee since she no longer supervises other employees or has management responsibilities?

  • Almost every AA will be classified as nonexempt and should be paid for their hours worked including overtime. The only AA I ever knew to be exempt from overtime was at the executive level (president) with major responsibility and authority.
  • I agree with BSA. The exempt or non-exempt status never automatically follows the employee who changes jobs. Its determined solely by the content and duties of the newly assigned job. Our only Admin Asst is exempt; but, she works directly for the CEO/Chairman and has multiple discretionary, decision making jobs and regularly carries out direct business objectives when he's here and in his absence.
