  • Exempt salary, or non-exempt salary?
  • Exempt salary. Sorry about that.
  • Under FLSA, there is no maximum hours in a day an exmept employee is limited to. Remember, it's not the hours, it's the job (wasn't that the Army's motto for years) that the employer is paying for. So, while ridiculous, under FLSA, the emplyee could work 24 hours straight. I doubt if a state's law specifically addresses work hours in a day for exempt employees. And there is no maximum hours in a week an exempt employee is limited to.

Same thing with the meal period. Under FLSA, there is no requirement for a meal period. Usually, state law will address it, but even if it does, it may jus speak to the minimal length and requirement of a meal period after so many hours of work for the non-exempt employee. Where FLSA does speak to meal periods is when a non-exempt employee is not free from duties during the meal period.
