Non-Exempt Travel-Waiting Time

We pay our non-exempt overnight travelers for travel time from the time they leave the city until they arrive at their destination and when they leave their destination until they arrive back in the city, even if the hours go beyond normal work hours. They still feel they aren't being fully compensated because of the long check-in and waiting times. Have any of you had similar complaints from your employees, and if so, how are you addressing them?

  • Under FLSA, you are not required to pay an emplyee for itme spent on overnight travel -- assuming that time would no be the hours he would be working and that he performs no work. Thus, if you are paying the non-exmept emplyee for time spent on overnight travel, it's by company po9licy or practice.

    How much more time is this "wait"? If it is going to create some morale problems, even under your "beneficial" overnight travel practice, why not just go ahead and pay for the wait time since the employee hasn't checked into his room at that point and you could still considered it to be part of the actual travel time?
