exempt employee status

If an exempt employee leaves early for sick, vacation or personal reasons
can I deduct hours from his sick or vacation accrual as long as his salary is
not affected?

  • The short answer is yes. My understanding is that a salaried/exempt employee who works any part of a week, must be paid their salary in full for that week, regardless of how many hours they put in. They cannot be docked for any partial days missed, but can have their leave banks docked, if this is your company policy and it is clearly stated in your written policy rules for all employees to see. But when the leave banks run out, you cannot dock them for partial days or they will lose their exemption. The only time they can be docked for partial days is if they are taking intermittent FMLA leave (for personal medical reasons) which requires them to work partial days, otherwise it is illegal.
