Administrative Exemption

Does anyone have a questionnaire which would help determine if a position qualifies as an administrative exemption from the FLSA? The position in question is Administrative Assistant. Any help would be greatly appreciated.

I don't have a questionaire, but I can tell you that it's rare that someone qualifies for this in Wage and Hours' opinion. They have to have lots of discretion in acting, arranging their work, etc. Usually the only one that can qualify is the AA to the CEO/President if he/she truly acts an an Executive Assistant.

I look at this the same way that Margaret does. We only have one administrative type person who is exempt and that is our Executive Assistant. Wage and Hour frowns, frowns, frowns upon administrative assistant people being labeled "exempt". It generally becomes a problem when they leave and then complain to Wage & Hour when they were "forced" to work overtime without being paid for it.

A Wage & Hour investigator was here Wednesday on a complaint by a disgruntled former employee. He interviewed two employees we have on administrative exemption, and told me when he left that we passed with flying colors much to his surprise!

Also, how many people in your organization hold these jobs? Will you also tell us your total number of employees so that we know how that compares?
