registered nurses and exempt status

I have gotten two legal readings that registered nurses can be considered exempt employees based on the nature of their duties. According to my legal sources, our cardiology nurses can be considered exempt. Does anyone have any feedback on this, either way? Thanks!

  • I agree with you that nurses should be exempt. However in Washington State nurses have been successful in court decisions stating they are non-exempt.


  • I was audit by DOL and that subject came up. I will interpret the bureaucratic mumbling: If the nurse is an RN with a bachelor's degree you can probably make exempt stick. An RN in a two-year certificate program is a coin toss. I voted for the non-exempt. LPN or CMA is non-exempt as I read the auditor. In any case, accurate time keeping, by the hour is strongly recommended.
