Exempt Pay Reduction

Has there been a change to exempt pay deductions due to business clousure? I have found a few reports at SHRM and others stating that exempt pay may not be reduced becasue of: jury duty, attendance as a witness, temoporary military leave, absenses caused by the employer, absenses caused by the operating requirements of the busienss.
However, they may be reduced for absenses of one or more full days for personal reasons other than sickness or disability. Last time I checked the FLSA considers not being at work due to inclement weather a personal decision.

I would think that you would have to look to your own policy to see if it qualifies as personal leave. I don't believe there are any other federal laws that apply to your situation.

We pay our exempts when weather is an issue, whether we choose to close or not. If it is the employee's choice, we reduce their PTO bank. If no PTO time left, they get paid anyway.
