You somehow took a wrong turn, SL - this question would be better posed in Benefits or Employment Law. You might e-mail the editors and ask them to move your thread - it will get more visibility over there.
I don't believe there is any federal law regarding sick leave - you can offer it (or not) however you see fit. Unfortunately, I haven't a clue what your CA laws are, and they are most certainly more stringent than the feds. Hopefully one of your "neighbors" will chime in.
PS - you may have some morale problems if you pick and choose benefits, and people will probably think it's against the law if somebody else is getting it but not me . . .
