Draw against commission sales - time off benefits

We offer all employees time-off benefits (vacation, sick leave, holidays), including those who are paid on a draw against commission basis. We have a sales person who is in a 'deficit situation' - not enough commission to cover the draw or to cover time-off benefits. Is there a legal problem if we say no time-off benefits will be paid if the person is in a deficit situation?
