COBRA & NON PAYMENT

We have an ee who elected to continue health ins. under COBRA after being terminated. She was terminated on August 31st and elected COBRA immediately. Therefore, she had until October 15th to pay. She did not. I terminated her ins. as of Nov. 1. However, we still had to pay her premiums for Oct. & Nov. are we within our rights to demand payment for those two months of premiums??

We never enroll a Cobra participant until our TPA receives the first premium. If your carrier values your business, they may be willing to refund what you have paid and terminate coverage back to Sept. 1.

I really don't think the climb would be worth the view in trying to collect from an Ex EE.

Most insurance carriers allow you to term up to 3 mths prior, so term as of Oct 1 since no premium was received.

I'm surprised this issue isn't already addressed in your plan document or insurance agreement, but.. Assuming there have been no expenses incurred I would earnestly inform the "carrier" that coverage should be termed as of XXXXXX and your org refunded the premiums that were paid.

We terminate the employee's coverage when their employment ends, and then reinstate if they choose COBRA.
