90 Day COBRA Notice If Declined Coverage?

I always send the 90-day General Notice letter to new hires within 90 days of obtaining our group coverage. I have a new hire who has other health coverage and declined our group plan. Do I still mail this individual a 90 Day General Notice?

Yes, you should provide all eligible employees the general notice for COBRA, just to be safe.

I checked with my COBRA people and they said you do not need to send the notice if someone has waived coverage. For someone who has not elected coverage, you don't need to tell them they can continue coverage if they don't have it to begin with. If they do sign up at a later time during open enrollment you would need to send it then.

I would not send the 90-day notice. That is the initial notification of COBRA coverage and if they do not take your insurance, the point is moot.
