working at home while on dbl?

Hi everyone, I have an issue here that I need your advice on. I have an ee who is pregnant. She has had complications including appendicitis during this pregnancy and obviously she is legitimately out on dbl. The problem, she reports to CEO ( she is in the financial department) She has asked to work from home while she is on dbl and CEO is allowing it. AND he is paying her for the hours she is working. I know I can direct her dbl cks to be issued to me as the employer, HOWEVER the point is that she is actually working. Last week she clocked in for 36 hours. She can terminal in to access her desktop and even clock in remotley. (the first 2 mistakes) RTW date on the dbl form is 3/2006. I am not in agreement with her working from home when the doctor says she cannot work at all. I am thinking that she is not telling her doctor that she is working from home, I am also considering asking her for a note from the doctor stating that it is ok for her to work from home, I do not mind accomodating her because we are able to do that very easily, however I do mind going against the doctor's orders. I welcome any comments, suggestions, constructive criticism , loaded gun ..... thanks and happy Friday to all..

  • I am writing without knowing what the expected delivery date is. First, you should notify the insurance carrier that she is being paid by the company to work at home. Second, you should advise the CEO of your concerns. Probably updated medical info is needed. Also, point out that if the ee is collecting DBL plus (assuming a 40 hour week) 90% of her salary, she is "earning" more than when she was working. Finally, do not forget that there is probably some politics involved. And the real finally, maybe you should do Second before First.

  • sorry, edd is 2/7/2006. CEO has been advised, he is not really listening to me, (politics??? you bet) the dbl claim form just arrived in my office yesterday, so carrier is not aware of a claim yet. It is in the process of being filed now. Being paid while on dbl is one thing,(as a rule we always make up the difference of the ee's salary so they are paid a full check while they are out, they are never working also, until now) being paid to work while you are deemed disabled by a physician is another. I guess my biggest worry is that down the road does she have any thing on us if somthing goes wrong with the childbirth or baby after it is born, can she say "well I had to work while doctor said I was to be out on dbl, this is your fault see you in court" btw, just received word that she called a coworker and said that the doctor said she may be able to come back to work in a week.. guess I better get on the phone with her and see how she is doing. I appreciate your feedback.
