How long do you keep your pre-tax selection forms for your Sec-125 plan?

What about plan selection choice for your health insurance?

  • Since these items are related to the company's income tax situation(s), I would think that as long as the tax return is subject to audit, the underlying records should be kept. Usually that is 3 years, but because of the ability to extend amend tax returns for up to 3 years, you have to add that into the mix. I keep this stuff for 7 to be safe.

    Unless you have some litigation pending, that is.
  • Although I do keep this information separate from an employee's personnel record, I keep these files as long as I keep their personnel file (I view it all as employee/employment information and keep it for at least 7 - 10 years beyond the date of their termination). Maybe a little excessive but I have had to pull employment information on old employees and it has become a matter of policy within the company.
