Cobra notice

When I sit down with ees before their last day unpon resignation I show them what their COBRA payments will be. Nine out of ten do not take it because it is so expensive and they really don't realize how much to company is paying! My question is if an ee CHOOSES coverage for themselves and their dependents do you still send out the notification to the dependents. I do so when they decline COBRA but was wondering if it is necessary if they take it.

  • In my opinion, you should be sending an election notice by certified mail, return receipt requested for each covered, terminated employee. You should protect your company because there are penalties for not sending the notice timely. You can't prove it if you do this in person at termination. If, to the best of your knowledge, the covered dependents live with the employee/participant, you can send one notice with all of their names on it and all of the costs. Otherwise, go with the latest information you have on the dependents.
