HIPAA and Workers' Comp

A colleague of mine tells me that an employee's Workers' Comp information is NOT covered by HIPAA. Is this true? In other words, would the handling of a file containing WC information not be subject to the Privacy Rule?

Your colleague is correct.

Any information gathered in the course of doing business: workers' comp., FMLA, ADA, disability, is not covered by HIPAA. Of course you must still maintain confidentiality with this information.
