Vacation accrues for over 40 hour week

Our vacation accrues as you work, on straight time hours paid including, vacation, sick and holiday’s. Vacation time is not accrued on time paid at the overtime rate. Many of our employees work 4 10’s so if a holiday falls on a Friday and it is our busy season we will have the employees work the 4 10’s and pay them for the holiday to (48) hours.

If anyone out there accrues vacation this way what do you do when employees are paid more straight time hours then the normal 40 per week? Do you let them accrue additional vacation hours or do you cap it at what the accrue rate for a year would be?
