Another pregnancy question.

I am just trying to get a feel for how some of you have handled employees with compliacted pregancies. We have an employee who has just informed us that her doctor has ordered her to be on complete bed rest as a result of her high risk pregnancy. She estimates that she will be out 20 weeks (before the child is born) as a result. Outside of the 12 weeks of FMLA what are our legal obligations to hold a position open for her upon her return. Is there any kind of legally mandated job protection after the 12 week period? We are located in North Carolina. Is it typical for a company to be accommodating in a situation like this? She is a good employee overall. Thanks in advance for any advice you may offer.

  • None that I know of. Keep in mind if you extend her time past the 12 weeks you have set a precedent. If you don't follow that precedent in the future you may be in hot water. You could term her after the 12 weeks and allow her to re-apply. Just make sure your company has not extended the leave time for others.
