For those with a tuition reimbursement policy, do you require an employee who leaves the company to repay any reimbursement they've received during the 12-months before their date of termination?
Yes, we require repayment of 100% if they leave within 6 months of completing the course, and 50% if it was between 6 months and a year. My $0.02 worth! DJ The Balloonman
We only reimburse 50% of tuition and books after the course is completed and the EE has received a grade of C or better. We do not require reimbursement if they leave.
You might check your state case law. In WI, there's case law that basically says that the reimbursement has to be reasonable and proportional to the time spent at the employer after reimbursement. Under our policy, employees agree to the reimbursement when they apply for tuition aid, and have to pay back the full amount if they stay less than a year, 2/3 for less than two years, and 1/3 for less than 3 years.
Our policy states that tuition reimbursement is a loan. If the EE stays for a year after course completion, the loan is forgiven, if not then it must be repaid.
Question- Re the 12 month-period after completing a class, is there a policy difference between "how" an employee is termed ??? I can imagine someone being laid off or fired before the 12 months is over, then while facing unemployment - being told to pay the tuition bill...
Our Tuition Reimbursement Form states that if the employee VOLUNTARILY leaves within 12 months then they have to reimburse any tuition money paid to them in the last 12 months.
We are not in business to put employees through school. They were hired for the qualifications they already had. BUT, we do like our employees to further their education so we offer 50%-65% reimbursement up to $1,000 per year with the requirement of repaying the reimbursement if they voluntarily leave before 12 months.
For every course we pay for the employees agrees to remain with us for a specified period of time...if they are terminated or resign before the tuition is "paid off" it must be repaid.
We don't pay for books or anything and the amount of reimbursement is based upon the grade received.
We're in the process of revising our policy, if you'd be interested in a draft.
