Open Enrollment & COBRA

December is open enrollment for our health insurance. Do I need to include those individuals on COBRA? What type of notice do I send them? Thanks.

  • They are entitled to the same information as your current employees (i.e. premium increase; right to switch plans, etc.). You should send them a letter explaining that it's renewal time and what the new premium is and (if you have alternate plans that you offer) give them the opportunity to switch to another plan. Send the letter via certified mail, return receipt req. Offer it to any of their dependents as well.
  • If your question is whether people that are dropped during open enrollment are COBRA Qualified Beneficiaries,in general the answer is NO. You do not offer COBRA to someone who is dropping coverage as a choice. However, if a enployee is dropping a soon to be ex-spouse, the employee is obligated to tell you that so that you may offer COBRA upon due to the divorce (and only from the date of the divorce).
