Lay-off after LTD

Our company doesn't qualify under FMLA. We have an employee off on long term disability benefits and will be returning late this year. She's been off since Feb. The department she worked in has changed and positions rearranged during this time and we may not have a position available when she is ready to return. If we do, it may be considered a demotion. Are there any concerns?
