Wages in Lieu of Notice


I'm wondering how many of you pay wages through the notice period given by a resigning employee when you tell them it is not necessary to work the full notice period.

  • We do. Mostly to avoid the state's view that the termination was involuntary and therefore entitles the employee to u/comp.
  • Although Down-The-Middle's response is valid, I feel a more compelling reason to do it is to cut your losses, go ahead and transition the ee off the property and start the process of 'working around' the loss of the employee. Although some of us are from the credibility school that taught us to dig in and have an orderly transition of duties when we leave a job, many others, most in fact, stir up stink (for lack of a better word) and spend 10 days bad-mouthing company decisions and raiding the pencil cabinet. Except in rare cases, I would recommend shaking hands, issuing the two week check and moving on.
