COBRA Notification

I am wondering if anyone would be willing to share the language they use for COBRA notification of a divorced spouse. Also, any advice if sending the notification was overlooked? This should have been done last summer but was not. Should I do it now?

  • Yes, you should do it now. Under COBRA, if a plan administrator fails to send a notice in a timely manner, it extends the period of time that a qualified beneficiary has to elect coverage. So the beneficiary's 60 days doesn't start running until the notice goes out.

  • Does anyone have language for an addendum to COBRA notices for the new AB1401, Cal COBRA? How are California employers out there addressing this?
