Flex Plan - Midyear change for higher co-pays?

Our Flex Plan operates on a calendar year basis but the contracts of our health plans renew at June 1. We have had to go with some plan design changes to include higher co-pays and deductibles. I will have ees who want to increase their flex plan election for such higher out of pocket costs now. Would this meet the change in status rules to allow mid-year flex plan changes? I thought the new regs addressed this but now I can't find it... Any insight you can share is greatly appreciated.
