ERISA for Public Employer

I recently read about a case where a public employer (Erisa exampt) lost their exemption because they listed as employees, employees of an entity to which they gave grant money. (the employees were not actually employees of the public entity). I am trying to locate information about the case.

Is anyone familiar with it?
