I do know that Kentucky has smoker's rights laws. I do not know what other states do. I would get some legal advice in your state. You will also need to check with an ERISA attorney.
If you are permitted to do this, I would suggest changing your focus to giving non-smoking employees a break on the cost of their insurance rather than punishing the smokers. Encourage good health. Economically, it will be the same to the company, but it will make a huge difference in employee morale.
