RELEASE FOR NON-WORK RELATED INJURY

Has anyone ever gotten an employee to sign a release for an injury that was non work related> if so, do you have a sample of form you could send?
We had an employee hurt his shoulder at home. Was very up front about it . Had surgery which doctor told them it may or may not work. We just want to have something in our files to cover ourselves down the road.

What is it that you want the employee to "release"? If the employee has already acknowledged the injury was off-the-job, why do you need a release? I don't think an employee can prospectively release things that haven't occurred yet, like a reinjury or aggrevation of the same injury on the job. If, in the future, the employee claims the job is aggrevating the off-the-job injury, it will be up to your workers' compensation carrier to apply your state's law to the specifics of this situation.

To be honest, and, again, I am not sure what you want the employee to release, I wouldn't sign a release.

We always require a return to work release if the employee is out for 3 or more days. In the case of surgeries or extended illness, we will require a return to work physical by our company physician.

Well, I tried to attach the form. But it exceeded the limit for the file type. I'm sorry. You'll need to go to the site ([URL="http://www.hrlaws.com"]www.hrlaws.com[/URL]) and sign up for the free trial period to get the form.

Just above the window where you type in a message is a tool bar with a paper clip. Click on that and follow the instructions.
