If a health care provider representing the employer may contact an employee's health care provider, with the employee's permission, for purposes of clarification and authenticity of the medical certification, what do you do if the employee refuses to give this consent?

Are you talking about a suspicious FMLA certification? If I explained my reasons for wanting another physician to talk to the employee's physician and the employee refused, I would deny the leave. If this means the employee is disciplined or terminated for excess time off, so be it. In fact, it is likely we would term anyway as the refusal is basically an admittance that the employee falsified the records.

Yes, I do suspect the FMLA certification is false as I stated in a previous post. Thanks for your response Nae.

I concur with NaeNae if the ee refuses then FMLA would be denied and attendance points and discipline would be issued.
