FMLA and owners, officers?

Does anyone know, in counting employees to see if we should be abiding by FMLA, do we count company owners & officers in that number? If yes, we are close to the 50 mark. If not we aren't. But I cannot find the answer to that question anywhere.

I believe the regs state anyone on the payroll. If your owners and officers are on the payroll (on the pay register), they get counted. If they volunteer or get paid via their stock, then they are not on the payroll and don't count.
