Just to avoid looking through a million Forum topics, I would like to know how many days an employee has to file a complaint at the Fed level for an FMLA violation. I thought it was 300 calendar days. Is that correct?
No. For FMLA, the default statute of limitations is two years, and in the case of a willful violation, someone can file a complaint up to three years after the violation.
300 days is the deadline for filing charges of discrimination at the EEOC that are also covered by state antidiscrimination laws. So that may be why that number popped into your head.
