Does bronchitis qualify as a chronic health condition? We have an employee who is a chronic attendance problem. We went over some changes in the department today and she had her physician sign her out the rest of the week because she is sick. She has been treated the last couple of weeks with antibiotics.

Where do you draw the line between a poor attendance record and having a physician sign you out as being sick because you don't want to adhere to changes in the department.

She has been counseled several times about her attendance and is now playing the "sick card".

Unfortunately if she is able to obtain medical certification keeping her off work for more than 3 days PLUS continuing treatment (prescription meds), this would qualify as FMLA so long as she met all the requirements.

Chronic bronchitis is also a symptom of COPD which is very serious. As in the last post if she has doctor certification she would probably qualify for FMLA and so your hands are tied.
