Medical Leave - Not Eligible for FMLA

Does anyone have a good option for addressing medical leaves for employees who have less than one year of service (and therefore not eligible fore FMLA)? We do have a leave of absence policy, but it's also for folks who have been around for more than a year. Would you recommend (or not) a medical leave policy for employees with less than one year of service?

  • Why would you want to open up that can of worms?

    If they are EEs you want to have back, then let them re-apply for any opening when their medical issues are resolved.

    If that is not sufficient, the first thing I would do is just amend the LOA policy to allow for the under 1 year folks.
  • We have a standard health leave policy (taken from our parent company) that was issued before FMLA. There are no specific time limits for employement, though there is a maximum of 6 months to be gone on leave. The policy states it will be on a case by case basis (depends on position, needs of employer and needs of employee).

    If we decided that we had a good employee we could use this to allow the employee leave for an urgent leave (not, for instance, for an elected surgery like a face lift). If we had a good employee who wanted leave for non-urgent reasons, we would probably give them the option to reapply. In the end it might not make any difference as we count prior work time if we rehire within 6 months.

    We issued a separate policy for FMLA so we have all our bases covered (I hope).

  • We allow half the FMLA time period (6 weeks or 240 hours) for those employees employed under one year.
  • we have a STD policy for 12 weeks at 50% pay. It kicks in with all other benefits: 1st of mo following 60 days.
    They're not covered by FMLA, so we can replace, but then we end up paying 150% for the job.
