Intermittent fml and holiday pay

This hasn't come up before. I have an ee taking interm. fml. She will work the day before the holiday but the doctor appt is the day after the holiday. Would you pay her for the holiday?
Our fml is unpaid so an ee on full weeks of fml would not get paid anyway but don't see anything in our policy addressing intermittent fml.

We pay for the holidays when the EE is otherwise receiving a check.

Is the appointment going to take all day? Perhaps the EE could report for work before or after the appointment.

Further, when the EE is utilizing FML, we require the concurrent use of paid leave banks until they are fully depleted.

Absence due to FMLA cannot be held against an employee due to an attendance policy. Does your policy state that the ee has to work the day before and afer a holiday in order to get it?

Yes, but we have decided to pay since we know this is bonified fml as she has always given me cards showing the next appointment date (not asked for but in this case has come in handy)so this has been an appointment date for quite awhile. Thanks!

In our company we would pay the holiday if the employee is certified for intermittent FML. I know it can be abused but I wouldn't punish them for using their entitled leave.
