Drug testing because of new work comp rules

I was wondering, when a employee fills out and accident/incident report, and then says they do not care for medical care. Can we still use the report to require a drug test, just to protect ourselves on automatic dismissal because of our company's no drug policy????

You can test in a situation like this, but if you do, you must do it each time it happens.
