I apologize in advance if this has been addressed in this forum already.
I have an employee who asked for 8 weeks of FMLA leave after having her baby. She is about 2 weeks from returning to work and calls to ask for an extension of time up to the full 12 weeks. I asked her if she intended to return to her position at all....she indicated that she did intend to return.
My question is are we required to let her extend the leave now. She followed proper procedure the first time and wanted the leave until November 15.
Thank you in advance for any advise on this matter.

She has to return to work for at least 30 days before this is not a factor.

I never knew this. Can you tell me where in the regs it states this so I can refer to it in the future?
Thank you!
